These Terms & Conditions apply to coaching, court rental, and related services offered by ACE TENNIS ACADEMY SDN. BHD. (SSM Registration No. 202501043834) (“Academy”, “we”, “us”). By booking, paying for, or using a service, or by using this website, you agree to these terms.
1. Services
We provide tennis coaching, court rental, and related services such as equipment rental, stringing, overgrip fitting, physiotherapy, sports massage, and ice bath therapy, as described on our website and as confirmed at the time of booking. Prices shown on the website are in Malaysian Ringgit. A booking is confirmed only after we accept it and, where payment is required in advance, after payment is received.
2. Bookings and packages
- Individual lesson packages of 4 or 8 sessions are valid for 30 days from the start date we confirm with you.
- Individual lesson packages of 12 or 24 sessions are valid for 60 days from the start date we confirm with you.
- Coaching courts are subject to availability and may be shared with other players during a session, as stated on our price list.
- Court rental is for the date, time, and duration booked. Non-peak rates apply from 11:00 AM to 3:00 PM, Monday to Friday. All other hours, and the whole day on weekends and public holidays, are peak hours.
- Unused sessions that expire at the end of the package validity period are forfeited unless we agree in writing to an extension.
3. Your responsibilities
- Give us accurate contact and player details, and tell us about any injury or condition that may affect safe participation.
- Arrive on time for the booked session. Late arrival does not extend the session unless the coach and court are both free to do so.
- Follow coach instructions and academy rules, and use equipment and courts with reasonable care.
- Where the player is under 18, a parent or guardian must make the booking and remains responsible for the player’s attendance and conduct.
4. Payment
Fees are payable in Malaysian Ringgit at the rates confirmed at booking. We may refuse or cancel a booking if payment is not received when due. You are responsible for any bank or payment-provider charges that apply to your payment method.
5. Cancellation, refunds, and delivery
Cancellation and refunds are governed by our Cancellation & Refund Policy. Scheduling and the start of classes or sessions are governed by our Service Delivery Policy. Those policies form part of these Terms & Conditions.
6. Health and liability
Tennis and physical training involve a risk of injury. You take part voluntarily and should only train if you are fit to do so. To the extent allowed by Malaysian law, the Academy is not liable for loss or injury caused by your own disregard of coach instructions, undisclosed medical conditions, or circumstances outside our reasonable control. Nothing in these terms excludes liability that cannot legally be excluded.
7. Website content
Text, images, and logos on this website belong to the Academy or its licensors. You may not copy them for commercial use without our written consent. Programme descriptions and prices may change. The price and terms confirmed for your booking apply to that booking.
8. Governing Law
These Terms & Conditions, together with the Privacy Policy, Cancellation & Refund Policy, and Service Delivery Policy, and any dispute or claim arising out of or in connection with them or with the Academy’s services, shall be governed by and construed in accordance with the laws of Malaysia.
9. Dispute Resolution
If a dispute arises out of these terms or our services, you must first notify us in writing at acetennisacademy@gmail.com or by WhatsApp at +60 11-5667 6863, and include a short description of the dispute and the outcome you are seeking.
The parties shall try to resolve the dispute in good faith by negotiation within thirty (30) days of that notice. If the dispute is not resolved within that period, either party may refer it to the courts of Malaysia, which shall have exclusive jurisdiction.
This clause does not stop either party from seeking urgent injunctive or interim relief from a Malaysian court where that relief is needed to protect a legal right.
10. Changes
We may update these Terms & Conditions by publishing a new version on this website. The version in force on the date you confirm a booking applies to that booking. Continued use of the website after an update means you accept the updated terms for future bookings.
